Who these terms are with
These Terms are between you and RUZIBA Group LLC, a Florida limited liability company ("we", "us"). They apply to your use of the HomeBrain app. You must be 18 or older to use HomeBrain, and old enough to make a binding agreement where you live (if that age is higher). By using HomeBrain you agree to these Terms. If you do not agree, do not use the app.
If you downloaded HomeBrain from Apple's App Store, Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies to your use of the app on Apple devices. These Terms add the HomeBrain-specific points below.
What HomeBrain is
HomeBrain is a private record-keeping app for your household. You can use it to record rooms, items, serial numbers, purchase and warranty dates, photos and documents, repair and contractor visits, and maintenance or warranty reminders. With HomeBrain Pro you can also make an encrypted backup and create a PDF of your home record. Your records are kept on your device: HomeBrain does not upload your home records. See the HomeBrain Privacy Policy at https://ruzibagroup.com/privacy/homebrain.
What HomeBrain is not
- HomeBrain is a private record, not a home inspection. It stores what you tell it. It never checks, diagnoses or certifies anything about your home.
- It does not replace a licensed inspection or professional advice (electrical, plumbing, gas, heating, structural or otherwise), permits or code compliance. It never gives instructions. Notes about what a technician or professional told you are recorded exactly as you typed them.
- Reminders are an aid, not a guarantee. A reminder only fires if your device allows HomeBrain's notifications, and the schedule is the one you set. HomeBrain does not know what maintenance your home needs or when. It reminds you only of the dates and intervals you enter, including warranty dates you type in, and does not check them against any manufacturer, warranty or legal requirement.
- A PDF export is a copy of what you entered. HomeBrain does not verify it. Anyone you give it to should treat it as your own record, not as a certified document. The PDF itself carries this disclaimer.
- HomeBrain does not recommend contractors, estimate costs or provide a marketplace.
HomeBrain does not replace emergency services, licensed inspections, professional maintenance advice or safety assessments. In an emergency (for example a gas smell, an electrical hazard, a fire or flooding), contact the emergency services or a qualified professional. Do not rely on HomeBrain.
Your data and your responsibilities
- Your device, your copies. HomeBrain does not upload your home records; they are stored on your device and in any backup or PDF files you create. We have no copy and cannot restore anything for you. Keeping your device secure and making backups is up to you.
- Backup password. If you forget a backup password, that backup cannot be opened by anyone, including us.
- Phone screen lock. HomeBrain has no PIN of its own and cannot reset or bypass your phone's passcode, PIN, pattern or biometrics, which the operating system controls. The lock relies on your phone's own security: it helps keep others out of your records but cannot guarantee that no one else can ever open them. If you lose access to your phone's screen lock, recover it through your phone maker's own process. If you must reset the phone or remove HomeBrain's data, you can restore from a backup whose password you know.
- Deleting data. Delete all data in Settings erases what HomeBrain stores on the device, including backup files HomeBrain made in its own storage. Copies you saved or shared elsewhere are not affected.
- Information about other people. Contractor names, contact details, costs and photos may be about other people. Only record and share information you are entitled to.
- What you share. A PDF is not encrypted. You decide where backups and PDFs go and who can see them.
- Use HomeBrain lawfully and do not try to interfere with it.
Language
The app is offered in English and, as Beta translations, in Bengali, Spanish, Hindi, Arabic, French, Portuguese, Indonesian, Urdu, Turkish and Simplified Chinese. The app shows a translation notice when a Beta language is chosen. These Terms are written in English. If a translation of these Terms differs from the English version, the English version applies.
Plans, advertising and changes
- HomeBrain Free is free to download and use for one home with up to 7 items. On Android, it may show one banner ad, labelled "Advertisement", from Google AdMob at the end of the Home and Rooms screens. Whether an ad appears depends on your consent choice, your region and the ads Google has available, so sometimes no ad is shown. Ads are non-personalized and never receive your home record. See the Privacy Policy for what Google's ad software collects and for Ad privacy choices. The current iPhone version shows no ads; before advertising is added to it, we will update these Terms and the Privacy Policy.
- Restoring a backup is free on every plan.
- We may update or stop offering the app. We may change these Terms. Updated Terms will be published at https://ruzibagroup.com/terms/homebrain with a new date.
HomeBrain Pro subscription
- HomeBrain Pro is an optional auto-renewing subscription, monthly or yearly. It removes ads (on Android) and the item limit, allows up to 3 homes, and adds the PDF full-home report and creating encrypted backups. There is no free trial or introductory offer.
- Price and renewal. The store shows the price before you buy; prices are set only in the stores. Payment is charged to your App Store or Google Play account when you confirm the purchase. The subscription renews automatically for the same period at the price then shown by the store, unless you turn off auto-renew at least 24 hours before the end of the current period (App Store) or cancel before the renewal date (Google Play). You manage or cancel it in your store account settings; after cancelling, Pro stays active until the end of the period you paid for.
- Billing, cancellation and refunds are handled by Apple or Google under their terms. HomeBrain cannot cancel, refund or see your billing. If Apple or Google refunds or revokes a purchase, Pro ends when HomeBrain next checks with the store. Deleting your data in HomeBrain does not cancel a subscription.
- When Pro ends, your records stay on your device. You keep every home and item and can view, edit and delete them. You cannot add a second home, or more than 7 items to a home. On Android, the Free plan's banner ads may be shown again.
- Use Restore purchases after reinstalling or on a new device.
- Nothing in these Terms limits rights you have under mandatory consumer-protection law that applies to you, including any right to withdraw from a purchase.
Warranty disclaimer and limit of liability
As is. To the maximum extent permitted by applicable law, HomeBrain is provided "as is" and "as available", without warranties of any kind, express or implied. This includes implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that HomeBrain will be error-free or uninterrupted, that a reminder will always be delivered, or that your records will never be lost. Keep your own backups.
Limit. To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost or damaged data, arising from your use of or inability to use HomeBrain. This includes damage to your home or property, missed maintenance, and a missed warranty claim or deadline.
What this does not limit. Nothing in these Terms removes or limits any right or liability that cannot lawfully be waived or excluded. That includes rights you have under mandatory consumer-protection law that applies to you, and our duties under privacy and security law that applies to us.
Governing law
These Terms are governed by the laws of the State of Florida, United States, subject to any mandatory law that applies to you and cannot be waived. These Terms do not require arbitration and do not waive your right to bring a claim as a class. Nothing in these Terms removes rights that cannot lawfully be waived.
